Terms and Conditions
Last updated: 28 October 2026
1. Scope and provider
These Terms and Conditions apply to all orders that you place through our online shop at lostpod.de. Your contractual partner is:
J.M. Bodin (sole trader)
Misdroyer Str. 58
14199 Berlin
Germany
Phone: +49 30 555 918 07
Email: kontakt@bodinos.de
A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial activity nor to their self-employed professional activity (§ 13 BGB [German Civil Code]). We do not accept any deviating terms unless we expressly agree to them.
2. Conclusion of the contract
The presentation of the products in the online shop is not a legally binding offer but an invitation to place an order.
This is how an order works: You add the items you want to the basket and go to checkout. There you enter your contact and delivery details and choose the shipping and payment method. Before submitting, you see an overview of all items, prices and shipping costs. By clicking the order button (e.g. “Pay now”), you submit a binding offer to purchase.
Immediately after you order, we send you an email confirming receipt. The purchase contract is concluded when we accept your order by email or dispatch the goods to you. For payment methods where payment is triggered directly when you order (e.g. credit card or PayPal), the contract is concluded as soon as the payment process is completed.
3. Input errors, contract text and contract language
You can correct input errors at any time before submitting your order: in the basket, in the input fields at checkout and in the overview before the order button. You can return to the previous step at any time using your browser's back function.
We store the contract text. We send you the order details by email with the order confirmation. You can view and save these Terms and Conditions on this page at any time. If you have a customer account, you can also see your orders there.
The contract language is English.
4. Prices and shipping costs
All prices are final prices and include statutory VAT. Shipping costs are added; they are listed on our Shipping page and are shown to you in the basket and at checkout before you complete your order.
5. Delivery
We deliver to the countries listed on the Shipping page. The delivery time is stated on the respective product page. If, contrary to expectations, an item is not available, we will inform you immediately and refund any amounts already paid without undue delay.
6. Payment
The payment methods shown at checkout are available to you. Where payment service providers are used, their terms and conditions also apply.
7. Retention of title
The goods remain our property until they have been paid for in full.
8. Right of withdrawal
As a consumer, you have a right of withdrawal. Details can be found in the instructions on withdrawal. You can also withdraw directly using our “Withdraw from contract here” function.
9. Legal guarantee
The statutory rights regarding liability for defects apply. You can find an overview of your rights under Your legal guarantee rights. Guarantees from the manufacturer, if any, exist independently of this in accordance with the manufacturer's terms.
If the buyer is a trader, the limitation period for claims for defects is one year from delivery, except for claims for damages under clause 10.
10. Liability
We are liable without limitation in cases of intent and gross negligence, for injury to life, body or health, under the German Product Liability Act (Produkthaftungsgesetz) and to the extent of any guarantee we have given.
In the event of a slightly negligent breach of an obligation that is essential for achieving the purpose of the contract and on whose fulfilment you may regularly rely (cardinal obligation), our liability is limited to the foreseeable damage typical for this type of contract. Otherwise, liability for slight negligence is excluded.
11. Dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer conciliation body (§ 36 VSBG [German Consumer Dispute Resolution Act]).
12. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you retain the protection of the mandatory consumer protection provisions of the country in which you have your habitual residence.
If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is Berlin.
If any provision of these Terms and Conditions is invalid, the remainder of the contract remains valid.
